Rick Posted November 16, 2002 Posted November 16, 2002 I gotta get out of a situation.....I bought a timex watch called the pager watch. I messed up thinking it was the same as another model that they have on sale that comes with a year of free paging service. The one I bought does not come with this deal. I would return it but the problem is that in big red letters, it says non-refundable and non-returnable. I don't want this watch and I made an honest mistake in thinking I was getting the same thing.Does anybody have an idea of how I can get out of this and have the watch sent back? I called customer and they were like, "so sorry". It has already been pulled and awaits shipping which means my credit card has been billed. Tried to do a stop payment and of course what I just explained tells why this was not possible. Give me some tricks!Rick

FthrJACK Posted November 16, 2002 Posted November 16, 2002 dont consumers in america have ANY rights? you should be able to return it even if it does have some dumb note saying you cant, check your rights!Also.. you bought it on a credit card... over here that counts as a credit agreement (kinda) and you have a period of days (i think 7) that you can return it anyway.failing that, how did you order it? if by post or something wait till your CC bill comes then ring the credit card company and scream theft. you will have to get a new card issued etc.. lot of hassle but if you want your cash back...if you went in the store and bought it and your on camera too forget it, you will land in court! lolif you bought it on the web.. well your ip might get looked up = same result. i would expect the card company wouldnt bother investigating a small claim like that tho and just issue you a new card and reverse the transaction.

Almost all US credit card companies cover this type of situation. Another option - when the watch gets to you - DO NOT OPEN the box. Slam return to sender on it and drop right back in the post box. Then tell your credit card company you never received it and you want a credit.LS_Dragons

I may give that at try. Fthrjack..I did make the purchase online so my IP address is probably recorded. :-(We'll see what happens.

We ended up emailing a letter to customer service and cc to the President of the company. The President's rep called us and made the exchange happen. Try calling or emailing the President and see what happens.A different angle. Tell them you were going to do a review of the watch you really wanted on the web site and need to straighten it all out before the review date? Companies get off on that sort of thing!

zipp51 Posted November 16, 2002 Posted November 16, 2002 Rick, i know it has been pulled for shipping but have you tried calling the distributor that you bought from directly and simply tell them you made a mistake as you have stated.Try pestering them,usually you can get them to take the unwanted item back by buying what you want and then they will credit your account when you send the former back.They give you a RMA # to put on the box.I have done this many times with computer parts.Good luck.

Anyway, I'm gonna "Return to Sender" and fuss like crazy about gettins something that I didn't order. If something goes wrong and I end up with a $50 paperweight..I'll either Ebay it or give it away as a Christmas gift. You know, I owe Chris for all the disks he has sent me! LOL Rick
